Your right to accept or refuse health care

When it comes to health, the law gives you some rights, such as accepting or refusing health care.

Healthcare profesionnals must obtain your consent before any care.

At any time, you have the right to accept or decline that care, in whole or in part. 

Consent

That right to accept or decline any care is called consent. It applys for medical exams, tests, treatments or any type of interventions.

If you are unable to give your consent because, for example, you are uncounscious, consent will be requested from your legal representative or from the court, following the steps of the Civil Code.

Examples

Sophie goes to her regular prenatal appointment

Sophie is 20 weeks pregnant and is experiencing some complications. After the usual questions, the doctor tells her to prepare for a gynecological examination. Sophie is not comfortable having this test, because her doctor is a man and that she does not understand the connection between the examination and her complications.

After discussion with her doctor, Sophie decides to refuse the examination, which is respected.

You have a heart discomfort and need to be transported to the emergency

The doctor tells you that you are going to have to undergo a multitude of tests to try to find out what is wrong.

In order to give you the right to accept or refuse them, in whole or in part, the doctor must give you clear and complete informations about all the tests he wants to do.

If you're not comfortable with a treatment offered to you, speak with the professional involved.
